The case study is about the issues faced by the employees after employment through the agency and the court cases faced by company due to these. The employees claimed that they were terminated in an unfair manner and the company defended themselves by saying that as they are a short-term hiring company they do not guarantee work for anyone. The data of the employees were recorded by the company and used as evidence in the court. The employees were concerned about this issue and filed an appeal to view their records. The management was worried about this and they became more careful while recording this (Burmeister et al., 2014). The ethical, professional and legal issues related to the case The issues related to this case study are that the Recruitment Manager Stella has to decide whether the decision of the management to use code words while recording the data of the employees were right or not. Stella also has to decide that whether this process undertaken by the management hampers the privacy of the employees or not (McDermid, 2015). Ethical issues in the case related to the ACS Code of Ethics The decision of the management does not correspond with the following values as stated by the ACS Code of Ethics (Acs.org.au, 2017), The Enhancement of Quality of Life- The company has violated this code of ethics as they are not trying to enhance the quality of life of the employees in the organization or the clients of the organization as well. The management is in fact trying to use the personal information of the clients or the employees against them. Honesty The company is not honest with the clients or the employees to whom they are providing jobs, the reason being that they are planning to record the information of the employees using code words so that they are aware of the fact. Professionalism The management is violating this code of ethics as they are not trying to improve the society by their work. They are trying to cheat their clients who provide them with profits to defend themselves. Issues related to the Code of Professional conduct stated by ACS According to the Code of Professional Conduct as stated by ACS, in relation to the above stated values considered by the organization, the following points related to Information and Communications Technology (ICT) are applicable (Al-Saggaf and Burmeister, 2013), Code violated 1.2.2(a) The management has violated this code by not trying to enhance the quality of life of their clients and by not providing them the correct opportunities. Code violated 1.2.2(c) The management of Jobs for You is not trying to understand the perceptions of the people or the clients who are affected by their work process. Code violated 1.2.3(b) The management has violated this code by providing the clients with inappropriate job opportunities to enhance their own profits. Code violated 1.2.3(g) The company has violated this code by trying to defend themselves by using the personal information of the clients. Code violated 1.2.6(b) The management of the company is not attempting to improve the society by helping its members. On the other hand, they are trying to just defend their mistakes at the cost of the personal information of their clients. Recommendations related to the case study In relation to this study it can be recommended to Stella to not support the decision made by the management of the company. The reason being, that this decision serves the interest of the company and is hurting the interests of the society at large. The actions taken by the company may not be illegal, however, this can affect the professional lives and career of the employees. Alternative course of action On the other hand, instead of breaking the Professional Code of Conduct, the organization should aim to provide suitable job opportunities to their clients.
